Benefits under Book II of the Social Code (ALG II) and Book XII of the Social Code (social assistance)

In principle, being a student entitles one to receive BaföG and therefore excludes one from receiving ALG II benefits. This applies regardless of whether BaföG is actually received or not.
However, exceptions apply to students with disabilities, chronic illnesses or mental health conditions, which are discussed below.

Additional expenses not covered by BaföG or health insurance can also be claimed. Costs for one-off and ongoing needs, such as hygiene products and therapies (not covered by health insurance!), can be met through social security benefits.

Students living with their parents can apply to have their BaföG payments topped up by social security benefits if

  • they are receiving BaföG
  • they are not receiving BaföG due to their assets or income
  • the decision on their BaföG application has not yet been made

If a break in studies lasts for up to 3 months, BaföG can still be claimed, as students are still regarded as capable of working and have the status of ‘in training’. This therefore excludes entitlement to ALG II.

If a break in studies lasts for more than 3 months but less than 6 months, an application for ALG II may be made where appropriate. 
The status of ‘not in a training relationship’ – for example, due to a leave of absence – disqualifies the student from receiving BaföG funding, meaning that an application for ALG II can be made. 
Please note: If a leave of absence does not result in the status of ‘not in a training relationship’ – for example, because academic work can still be carried out – ALG II cannot be claimed. Furthermore, unlike a leave of absence, ALG II cannot be claimed retrospectively.

If a break from studies is (expected to) last longer than 6 months, the status ‘temporarily fully incapacitated for work’ and ‘not in a training relationship’ applies, meaning that you may be entitled to a living allowance under SGB XII, Chapter 3.

If there is a lengthy transition period between your Bachelor’s and Master’s degree programmes, your entitlement to BaföG may cease. During this interim period, you must register as a jobseeker with the Jobcentre and fulfil all your obligations regarding job-seeking. It is possible to apply for ALG II during this period.
